1. Overview

1.1 The following terms and conditions govern all use of the SIA “Root XP”, registration No. 40203313229, registered on 26.04.2021 in the Republic of Latvia (further - “Root XP”) website and all content, services and products available at or through the website. The Website is owned and operated by Root XP and is available at triseotrops.com.
1.2 The Website is offered subject to Your acceptance without modification of all of the terms and conditions contained herein and all other operating rules, policies (including, without limitation, Root XP’s Privacy Policy) and procedures that may be published from time to time on this Site by Root XP.
1.3 By accepting these Terms, or by accessing or using the Service or Site, You represent and acknowledge that You have read, understood, and agree to be bound by these Terms, and that the information You provide in registering to the Service is accurate, complete, and is Yours or within Your right to use.
1.4 If You are entering into these Terms on behalf of a company or another legal entity, You represent that You have the authority to bind such entity and its affiliates to these Terms, in which case the terms “You,” “Your” or related capitalized terms herein shall refer to such entity and its affiliates. If You do not have such authority, or if You do not agree with these Terms, You must not accept these Terms and may not use the Service.

2.1 The “Service” includes: (a) the Website; (b) the on-demand SEO analysis and website crawling platform operated by Root XP, including dashboards, tools, APIs (if applicable), and reports; and (c) other services provided to You through the Website based on the selected plan, including all software, data, text, images, recommendations, metrics, and other content made available through the Website or generated by the Service (collectively, the “Content”). The Service is designed to crawl and analyze websites to identify technical, on-page, and structural SEO issues and potential improvements. Any new features added to or augmenting the Service are also subject to these Terms.
2.2 The Service may include basic or expanded support depending on the plan purchased. Root XP will use commercially reasonable efforts to make the Service available in accordance with the applicable plan, except for planned maintenance or downtime (with reasonable notice when possible) or unavailability caused by circumstances beyond Root XP’s reasonable control, including but not limited to acts of God, acts of government, acts of terrorism, civil unrest, internet service provider failures, or infrastructure outages.

3.1 In providing the Service, Root XP shall maintain appropriate administrative, physical, and technical safeguards designed to protect the security, confidentiality, and integrity of Your data and any personal data processed in connection with the Service.
3.2 These safeguards include encryption of data in transit (using SSL or similar technologies). The Service may integrate with third-party services (such as Google OAuth) which are governed by their own security and privacy practices.

4.1 The Service is made available on a subscription and/or usage-based basis and is charged at the start of the selected billing period (generally monthly or annually, depending on the plan).
4.2 Subscriptions renew automatically at the end of each billing cycle unless canceled prior to renewal. You may manage or cancel Your subscription through the account dashboard. You will not receive separate notice prior to renewal.
4.3 If You upgrade Your plan during an active billing period, any additional charges may be prorated and applied immediately or on the next billing cycle. Downgrading or canceling a plan may result in loss of access to features, capacity, or stored data. Root XP is not responsible for any such loss. No refunds or credits are provided for partial billing periods or unused time, except where required by applicable law.
4.4 Payments are processed by Stripe, a third-party payment processor. Root XP does not store full payment card details. Stripe’s processing of Your payment information is governed by Stripe’s own terms and privacy policy.
4.5 Payment transactions are protected using industry-standard encryption. Root XP does not have access to or store Your full payment credentials.

5.1 Root XP reserves the right, at its sole discretion, to modify or replace any part of these Terms. It is Your responsibility to review these Terms periodically. Your continued use of the Website or Service following the posting of changes constitutes acceptance of those changes.
5.2 Root XP may also introduce new services, features, or tools, which shall be subject to these Terms unless otherwise stated.

6.1 Unless otherwise explicitly stated, subscription fees are non-refundable. Refunds, if any, are provided solely at the discretion of Root XP or where required by applicable consumer protection laws.

7.1 Root XP reserves the right to refuse, suspend, or terminate access to the Service at its sole discretion, including but not limited to cases of misuse, violation of these Terms, or illegal activity.

8.1 By submitting a website, domain, or URL for analysis, You represent and warrant that You have the legal right and authorization to request crawling and analysis of such resources.
8.2 You agree not to use the Service in a manner that violates applicable laws, third-party rights, or the terms of service of search engines, websites, or platforms being analyzed.
8.3 You agree to indemnify and hold harmless Root XP from any claims, damages, losses, or liabilities arising out of Your misuse of the Service, including unauthorized crawling or analysis requests.

9.1 The Service is provided on an “AS IS” and “AS AVAILABLE” basis. Root XP makes no guarantees regarding uptime, accuracy of data, rankings, traffic improvements, or business results derived from the use of the Service.
9.2 Root XP shall not be liable for system downtime, data loss, or any indirect, incidental, or consequential damages, including lost profits or lost business opportunities.
9.3 Root XP is not responsible for errors caused by incorrect configuration, misuse of the Service, repeated crawl submissions, or improper interpretation of provided data. The Service provides tools to manage and limit usage, and You are responsible for using them appropriately.
